It should not matter that the written agreement was transmitted by e-mail.  New Jersey has enacted the Uniform Electronic Transactions Act, N.J. Stat. § 12A:12-1, et seq.  That Act merely validates transactions conducted electronically.  N.J. Stat. § 12A:12-7.  It does not appear to supersede the common-law rules on delivery of contracts.
