The determination of whether laches applies is a fact-intensive inquiry. “Whether or not laches bars a claim must be determined by examining the underlying facts and circumstances of each particular case.”  Stenehjem ex rel. N. Dak. v. Nat’l Audubon Soc’y, Inc. No. 20130279, 2014 ND 71, at ¶ 13 (N.D. Apr. 8, 2014) (quoting Williams County. Soc. Servs. Bd. v. Falcon, 367 N.W.2d 170, 174 (N.D. 1985)).
